FTC on Spam / Sobre SPAM: FTC

Acabo de ver un artículo de 2002 de la Comisión Federal de Comercio de los EE. UU. que detalla las Respuestas y responsabilidades de la "Baja". Explica qué condiciones debe cumplir el correo promocional para no ser considerado "spam" bajo las leyes de los EE. UU.:
  • Las peticiones de baja ("remove me") deben cumplirse.

  • Los links de baja ("remove me")

  • "Cualquier sistema colocado para manejar las peticiones de baja debería procesar estas peticiones de manera efectiva"

  • "El Acta de la comisión Federal de Comercio prohíbe la publicidad desleal o engañosa en cualquier medio, incluido el correo electrónico."

  • También se incluye un enlace a un formulario de quejas. Esta última página no debe faltar en nuestros "Favoritos"!



    I've just saw a 2002 FCT paper explaining "Remove Me" Responses and Responsibilities. It explains how to not spam an address under USA laws:
  • Removal claims should de honored

  • Removal links should work

  • "Any system in place to handle unsubscribe request should process those request in an effective manner"

  • "The Federal Trade Commision Act prohibits unfair or deceptive advertising in any medium, including in email"

  • It includes also a link to a complaint form. This last page is a must for our bookmarks!

    Too bad we can't tell honorable spam from unhonorable spam. Even if the company will honor the 'remove me' link, I can't tell that. So I don't take the risk.

    That is where the CANSPAM act fails. You can't tell the difference, and so must assume that all spam is dishonorable and deal with it accordingly, by forwarding it to uce@ftc.gov, then /dev/nulling it with the delete key. Or, if you have control of the email server, with a domain banning like I have.
